Nickel Studio Böhi offers the following services:

The exact scope of services is defined in the quote accepted by the client for each project.

Each project is subject to a detailed quote, sent by email or delivered in person. The quote is valid for 30 days from the date of issue, unless otherwise stated.

The order is considered firm upon written acceptance of the quote by the client (email, signature) and payment of the agreed deposit.

Prices are quoted in Swiss francs (CHF), VAT not applicable (sole proprietorship not subject to VAT below the CHF 100,000 annual turnover threshold).

Payment terms:

• 50% deposit upon order (acceptance of quote)
• 50% balance upon project delivery

Invoices are payable within 30 days of issue. In case of late payment, a reminder will be sent. Default interest of 5% per annum may be applied in accordance with Swiss law (Art. 104 CO).

The client may cancel an ongoing project at any time by written notification (email).

In case of cancellation:

• The deposit paid remains with Nickel Studio Böhi
• Work hours already performed beyond the deposit will be invoiced at the hourly rate agreed in the quote
• Elements already completed will be delivered to the client in their current state

Nickel Studio Böhi reserves the right to suspend or terminate a project in case of non-payment, abusive behavior, or breach of the client's obligations.

Upon full payment of the project, the client receives a non-exclusive license of use for the deliverables specific to their project (design, customized content).

The following remain the property of Nickel Studio Böhi:

• Source code, components and tools developed
• Frameworks, libraries and methodologies used
• Generic reusable elements

The client is not authorized to resell, redistribute, or sublicense the source code without prior written agreement.

Nickel Studio Böhi reserves the right to mention the completed project in its portfolio and communications, unless otherwise agreed.

A 30-day correction period is included after the final delivery of the project. This warranty covers:

• Bugs and technical malfunctions
• Deviations from the validated specifications

Not covered:

• Content or feature modifications not specified in the original quote
• Issues caused by third-party interventions on the project

Beyond this period, a maintenance contract may be offered to ensure ongoing support and project evolution.

Nickel Studio Böhi commits to performing its services with due care and according to best practices.

The liability of Nickel Studio Böhi is limited to the total amount of the project concerned. Under no circumstances shall Nickel Studio Böhi be held liable for:

• Indirect damages (loss of revenue, loss of data, etc.)
• Delays caused by the client (late content delivery, slow validation, etc.)
• Issues related to third-party services (hosting provider, external APIs, etc.)

Nickel Studio Böhi is committed to protecting personal data in accordance with the new Swiss Federal Act on Data Protection (nFADP) which came into force on September 1, 2023.
